CBI – www.publictrustofindia.com https://publictrustofindia.com Odisha English News Sat, 06 Jan 2024 08:07:41 +0000 en-US hourly 1 https://wordpress.org/?v=6.9.4 CBI To Probe Delhi’s Mohalla Clinics; Allegations Include ‘Fake Patients & Tests’ https://publictrustofindia.com/2024/01/06/cbi-to-probe-delhis-mohalla-clinics-allegations-include-fake-patients-tests/ Sat, 06 Jan 2024 08:07:40 +0000 https://publictrustofindia.com/?p=8047 New Delhi: Delhi Lt Governor VK Saxena has called for a CBI probe into alleged irregularities involving fake lab tests and ‘ghost patients’ at Delhi government-run Aam Aadmi Mohalla Clinics (AAMCs), Hindustan Times reported. The development comes on the heels of Saxena ordering a CBI probe into sub-standard drug samples collected from three government hospitals.

The alleged irregularities were identified through investigations conducted by the state’s vigilance and health departments in 2023.

Earlier, in August 2023, an investigation by the state’s vigilance and health departments revealed that doctors at Mohalla Clinics were fraudulently marking attendance, with some being absent from clinics where unauthorized staff prescribed medicines.

According to another scrutiny, 24,399 referral papers held by private labs had invalid mobile phone numbers, which, the LG said, was pointing to potential evidence of fake patients. These labs conducted lab tests offered by the government for free to economically disadvantaged patients.

A statement from Saxena’s office said that the inquiry uncovered tens of thousands of fake pathology and radiology tests conducted on non-existent patients. These purportedly fake tests were referred to private labs, and reimbursed by the government.

“Tens of thousands of tests were recommended prima facie to ‘ghost patients’. Empirical data proving entry of fake mobile numbers/blank mobile number of fictitious patients, fake attendance of doctors, and fictitious data of patients establishes wide spread corruption, manipulation of documents, forgery of records with the sole intention to loot government exchequer and extend undue benefits private parties operating the AAMCs as well as dispensaries, polyclinics and hospitals of Delhi government,” a note by Saxena on the findings of the inquiry read.

CBI files chargesheet against former BJD MlA Pravat Biswal in seashore scam https://publictrustofindia.com/2023/09/24/cbi-files-chargesheet-against-former-bjd-mla-pravar-biswal-in-sea-shore-scam/ Sun, 24 Sep 2023 08:38:31 +0000 https://publictrustofindia.com/?p=4963 Bhubaneswar: More than 9 years after taking over investigation into multi-crore Seashore chit fund scam, the CBI on Saturday filed chargesheet against former MLA Prabhat Ranjan Biswal and his wife Laxmi Bilasini Biswal.

According to sources, the Central investigating agency filed the chargesheet in designated CBI Court in Bhubaneswar under money laundering charge.

The CBI had arrested Biswal, the former BJD legislator from Choudwar-Cuttack, in 2017 in connection with sale of a piece of land in Jajpur district to Seashore Group. Biswal and his wife had sold the land to Seashore for a hefty amount and could not explain the details of the illegal transactions.

Investors were duped of their deposits through the Ponzi firms in the Rs 578-crore scam. The CBI took over investigation of 22 of the 41 FIRs registered against Seashore Group following the Supreme Court order on May 9, 2014.

While trial in 22 cases is pending before the Special CBI Court, the remaining 19 cases are pending in courts in different districts. The police stations in Dhenkanal, Rourkela, Soro, Nabarangpur, Jajpur, Berhampur, Titlagarh and Sonepur had registered the FIRs against the company.

Supreme court: No immunity for public servants in pre-2014 corruption cases https://publictrustofindia.com/2023/09/12/supreme-court-no-immunity-for-public-servants-in-pre-2014-corruption-cases/ Tue, 12 Sep 2023 08:19:45 +0000 https://publictrustofindia.com/?p=4408 Bhubaneswar: A five-judge constitution bench of Supreme Court has declared that its 2014 judgment, which struck down Section 6A of the Delhi Special Police Establishment Act 1946 granting immunity to central government employees at the joint secretary level and above from probe in corruption cases, will have retrospective effect.

“The judgment in Subramanian Swamy will have retrospective effect. Section 6A of the DSPE Act will be considered as having been not in force from the date of its insertion,” the constitution bench of Justices Sanjay Kishan Kaul, Sanjiv Khanna, Abhay S Oka, Vikram Nath and JK Maheshwari said on Monday.

This means that senior government officials involved in corruption cases cannot demand protection from coercive measures for the period between September 2003 , when the impugned law was framed, and May 2014, when the SC judgment invalidated the need for prior sanction.

Section 6A of the DSPE Act required the Central Bureau of Investigation (CBI) to obtain prior sanction from the central government to investigate corruption cases against an officer of the rank of joint secretary and above.

The bench further clarified that Section 6A was a procedural provision and that the 2014 decision on its validity had nothing to do with the applicability of Article 20(1), which lays down that no person shall be convicted of any offence except for violation of a law in force at the time of the commission of the alleged act.

The issue was first raised to the Supreme Court when the CBI approached it challenging a Delhi High Court order. A five-judge constitution bench in 2014 termed Section 6A a “discriminatory” provision that “impedes tracking down the corrupt senior bureaucrats”. Later in 2016, a two-judge bench in 2016 referred the questions whether there can be a deprivation of such immunity by a retrospective operation of a judgment of the Court, in the context of Article 20 of the Constitution of India, to a larger bench.

While hearing a petition filed by one Anshuman Kanungo, the two-judge bench of HC directed the central probing agency to complete the investigation within four months and submit a report.

The petitioner claimed that he had scored 98.97 per cent but later found some some discrepancies in the marksheet later and sent a mail to the authorities concerned for correction. However, the mark was subsequently changed to 37 per cent. He was also denied admission in any engineering college, including NIT-Rourkela, on the plea that the marksheet submitted by him was fake.

Anshuman’s lawyer, Akaya Kumar Panda, told the media that they argued that the marksheet was downloaded from the official website and it was later allegedly changed to accommodate another student from Uttar Pradesh.
